Important Legal Notice: These Terms of Service constitute a legally binding agreement between you and Ocean View Scooters (Pty) Ltd. Please read carefully before using our services. By booking or using our electric scooters, you accept these terms in full and acknowledge that you use our scooters entirely at your own risk.

Definitions and Interpretation

In these Terms of Service, unless the context otherwise requires:

  • "We", "Us", "Our", "Company": Ocean View Scooters (Pty) Ltd, registration number K2024593656, trading as Ocean View Scooters
  • "You", "Your", "Renter": The person entering into this rental agreement
  • "Electric Scooter": Any electric scooter, e-scooter, or related equipment rented from us
  • "Rental Period": The time from collection to return of the electric scooter
  • "Rental Agreement": The booking confirmation and these Terms of Service
  • "Damage": Any harm, loss, or deterioration to the electric scooter or third-party property
  • "Security Deposit": The refundable amount held against potential damages or violations

Agreement Formation and Acceptance

By using our website, making a booking, or taking possession of an electric scooter, you:

  • Confirm you have read, understood, and agree to be bound by these Terms
  • Acknowledge you have the legal capacity to enter into this agreement
  • Warrant that all information provided is accurate and complete
  • Accept responsibility for all consequences of electric scooter use during the rental period

Contract Formation: A binding rental agreement is formed when we confirm your booking and you take possession of the electric scooter. This agreement is subject to South African law.

Rental Requirements and Eligibility

Minimum Requirements

To rent an electric scooter from us, you must:

  • Age: Be at least 12 years old (under 16 requires parental supervision)
  • Identification: Provide valid photo identification (students can use school ID)
  • Payment Method: Cash, card, or digital payment for rental fee
  • Safety Briefing: Complete our mandatory electric scooter safety orientation
  • Parental Consent: Minors require signed parental consent form

Prohibited Renters

We reserve the right to refuse rental to anyone who:

  • Appears to be under the influence of alcohol or drugs
  • Has previously violated our rental terms or caused damage
  • Cannot provide required identification or payment method
  • Exhibits unsafe or reckless behavior during safety briefing
  • Refuses to follow safety guidelines or wear protective equipment

Verification Process: We may verify your identity and age before confirming your rental. False information will result in immediate cancellation.

Booking, Payment, and Rental Terms

Booking Process

  • Bookings can be made online, by phone, or in person
  • All bookings are subject to vehicle availability and our approval
  • We reserve the right to cancel bookings that don't meet our requirements
  • Booking confirmations will be sent via email with pickup instructions

Payment Terms

  • Payment: Full rental fee due at time of collection
  • Accepted Methods: Cash, credit cards, debit cards, and digital payments
  • Currency: All prices in South African Rand (ZAR)
  • Additional Charges: Damage costs and violation fees are extra

No Security Deposits Required

Hassle-Free Rentals: We don't require security deposits! Just pay your rental fee and enjoy your ride. However, you remain responsible for any damage caused during your rental period.

Electric Scooter Use and Restrictions

Permitted Use

  • Use only for recreational purposes and sightseeing
  • Operate primarily on sidewalks, pedestrian areas, and designated paths
  • Yield to pedestrians and maintain safe speeds (max 15 km/h)
  • Wear appropriate safety gear (helmets provided and mandatory)
  • Return electric scooter in same condition as received (normal wear excepted)
  • Charge the scooter as needed during longer rentals

Prohibited Activities

The following activities are strictly prohibited and will result in immediate termination of rental agreement. We accept no responsibility for any accidents or damages caused by renters.

  • Impaired Operation: Using electric scooter under influence of alcohol or drugs
  • Reckless Riding: Racing, stunts, tricks, or dangerous maneuvers
  • Unauthorized Use: Allowing others to operate the electric scooter without supervision
  • Commercial Use: Delivery services, ride-sharing, or business operations
  • Illegal Activities: Any unlawful use or transportation of illegal substances
  • Modifications: Altering, tampering with, or damaging scooter components
  • Overloading: Exceeding weight limits (100kg/220lbs) or carrying passengers
  • Improper Charging: Using non-approved chargers or charging in unsafe conditions

Geographic Restrictions

  • Use limited to Port Elizabeth beachfront and designated recreational areas
  • Stay on sidewalks, promenades, and pedestrian-friendly areas
  • Beach and waterfront riding in designated areas only
  • Avoid steep hills that may drain battery excessively
  • No riding in adverse weather conditions (heavy rain, strong winds)
  • Respect private property boundaries and "No Scooter" zones

Safety Requirements and Responsibilities

Mandatory Safety Equipment

  • Helmets: Safety helmets must be worn at all times (provided free)
  • Protective Gear: Knee and elbow pads recommended (available for rent)
  • Visibility: Bright clothing recommended; lights provided for evening rides
  • Communication: Working mobile phone required for emergencies
  • Closed-toe Shoes: Proper footwear required (no sandals or flip-flops)

Electric Scooter Safety Briefing

All renters must complete our mandatory electric scooter safety briefing covering:

  • Electric scooter operation and controls (throttle, brakes, display)
  • Battery management and charging procedures
  • Pedestrian courtesy and sidewalk safety rules
  • Emergency procedures and contact information
  • Route recommendations and hazard awareness
  • Proper parking and securing techniques

Accident and Emergency Procedures

In case of accident or breakdown:
1. Ensure safety and call emergency services if needed (112/10111)
2. Contact us immediately: +27 79 897 7065
3. Do not admit fault or make statements to third parties
4. Take photos and gather witness information
5. Obtain police report for all accidents involving injury or significant damage

Liability, Insurance, and Indemnification

Renter's Liability

IMPORTANT DISCLAIMER: Ocean View Scooters accepts NO responsibility or liability for any accidents, injuries, damages, or losses that occur during your rental period. You rent and operate our electric scooters entirely at your own risk.

Damage Responsibility: While we don't require deposits, you remain responsible for any damage to the electric scooter during your rental period. Damage costs will be charged after assessment.

  • Scooter Damage: Repair or replacement cost for damage beyond normal wear
  • Battery Damage: Battery replacement cost if damaged due to misuse
  • Lost Revenue: Daily rental rate for each day scooter is out of service due to damage
  • Third-Party Claims: Costs related to damage to other people's property
  • Administrative Fees: Processing fees for damage claims (minimum R100)

Limitation of Our Liability

COMPLETE DISCLAIMER: Ocean View Scooters, its owners, employees, and agents disclaim all liability for personal injury, property damage, accidents, or any other losses arising from the use of our electric scooters. Our maximum liability is limited to R0 (zero).

Use at Your Own Risk: By renting our electric scooters, you acknowledge that you are participating in an activity that involves inherent risks and you assume all such risks voluntarily.

Indemnification

You agree to indemnify and hold Ocean View Scooters harmless from all claims, damages, costs, and legal fees arising from your use of the electric scooter, any accidents you cause, violation of these terms, or breach of applicable laws.

Your Responsibility: You are solely responsible for your safety and the safety of others while using our electric scooters. We strongly recommend obtaining your own personal insurance coverage.

Cancellation and Refund Policy

Customer Cancellations

  • More than 24 hours: Full refund
  • Less than 24 hours: 50% refund
  • No-show: No refund, full charges apply

Our Cancellation Rights

We may cancel your booking and provide full refund if:

  • Electric scooter becomes unavailable due to mechanical issues or battery problems
  • Weather conditions pose safety risks (heavy rain, strong winds, storms)
  • You fail to meet rental requirements or provide required documentation
  • We determine rental would pose safety or security risks

Early Returns and Extensions

  • Early Return: No refund for unused time
  • Late Return: Additional charges at hourly rate plus penalties
  • Extensions: Subject to availability; premium rates may apply

Dispute Resolution and Governing Law

Governing Law

This agreement is governed by the laws of South Africa. The Consumer Protection Act 68 of 2008 applies where you qualify as a consumer under the Act.

Dispute Resolution Process

  1. Direct Resolution: Contact us first to resolve disputes informally
  2. Mediation: Binding mediation through accredited mediator if needed
  3. Jurisdiction: Port Elizabeth Magistrate's Court or High Court as appropriate

  • National Road Traffic Act 93 of 1996
  • Protection of Personal Information Act 4 of 2013
  • Electronic Communications and Transactions Act 25 of 2002

Changes to These Terms

We may update these Terms of Service to reflect changes in our business, legal requirements, or industry practices. When we make material changes:

  • We will post updated terms on our website with revision date
  • Existing bookings remain subject to terms in effect when booking was made
  • New bookings will be subject to updated terms
  • We may notify you of significant changes by email

Continued Use: Your continued use of our services after changes constitutes acceptance of updated terms. If you disagree with changes, please discontinue using our services.
